Food truck owners will go to trial in a lawsuit challenging a rule that stops them from operating near brick-and-mortar restaurants in Baltimore.
The Baltimore Sun reports the trial is scheduled for Sept. 28 after a Baltimore City Circuit judge denied requests for summary judgment from both parties Friday.
Food truck owners Joey Vanoni and Nikki Marks say the city law keeping food trucks from selling food within 300 feet (91 meters) of brick-and-mortar restaurants is unconstitutional, and prohibits operation in large swaths of the city. The owners say they want to bring their business to Baltimore neighborhoods with high foot traffic.
A pretrial hearing is scheduled for Friday.
